Introduction

This document contains Usportfor’s privacy statement. It defines how Usportfor handles your personal data.

This privacy statement provides you with all the information about the way in which your personal data is collected and how it is handled. It explains for example why Usportfor stores data and where your data is stored. In this privacy statement, you will moreover find out what your rights are and how you can make use of them. Usportfor may change its practices and this privacy statement if necessary. It is therefore advisable to consult this statement periodically.

Usportfor

Usportfor is a company for athletes by athletes. Our mission is to provide the 99% of athletes with the same visibility as the 1% top athletes. This allows young athletes to collect and share images of their achievements and build their own sports portfolio.

Usportfor’s automatic cameraman follows the game on the pitch or in the sports hall. It is up to the club to turn on the camera and record the match or training, for its own use (Private Mode) or to broadcast the footage live (Public Mode). Broadcasting takes place for example on the Usportfor platform, on the club’s website using the website plug-in and in the app. The images are the club’s property and the club has given Usportfor the right to use them.

All images are collected on Usportfor’s computers. That is why it is relevant for you to know what happens to the footage. That is what this statement is about.

Purpose of the data

Personal data is collected by USPORTFOR for a number of purposes:

    • Camera images

Usportfor has developed the automatic cameraman in order to film sports events. The camera is aimed at the sports pitch. The automatic cameraman is a computer programme that follows the game from a certain fixed point based on our algorithm. No images from outside the sports pitch are recorded. The club will inform you about the presence of cameras through information boards at the entrance to the club grounds.

The basis for recording and broadcasting the matches in public mode is USPORTFOR’s own legitimate interest (art. 6.1.f GDPR). The purposes of the processing are related to journalistic reporting reasons. According to the law, USPORTFOR, as the party who decides on the purposes and use of this activity, is the controller of these processing operations.

In private mode, an affiliated sports club can also make use of the basis of the legitimate interest or choose to request permission. Since the club is the one that decides on the purposes and stakes here, the club is legally the controller for the processing in private mode, USPORTFOR is in this case a processor. However, the club must make a distinction between persons in the age group under 16 years and 16 years and older (See also under the heading ‘security’).

    • Sending information

USPORTFOR may send you information. This information is commercial and/or used to share knowledge. Your first name and e-mail address are collected via the form provided on the USPORTFOR website. In addition, you may be asked to sign up verbally or textually.

    • Contacting Usportfor

When you contact Usportfor via the website, we ask you to enter the necessary details so we can answer your question, such as your name, company name, e-mail address, telephone number and project description. We keep this data so that we know what your question was in the future. This way you do not have to keep repeating yourself.

    • Cookies

USPORTFOR’s website and app collects your data in order to improve its website, app and services, which is done with the use of cookies. Cookies are small text files that can be used to make user experiences more efficient. The law allows us to store cookies on your device if they are strictly necessary for the use of the site. Your permission is required for all other types of cookies. Through the cookie statement on our website, you can see which cookies we process and you can change or withdraw your consent at any time.
Necessary cookies help make a website more user-friendly by allowing basic functions such as page navigation and access to secure areas of the website. Without these cookies, the website cannot perform properly. Statistical cookies help Usportfor understand how visitors use our website and app, data is collected and reported anonymously. Marketing cookies are used to track visitors when they visit different websites. The aim is to display advertisements that are tailored to and relevant to the individual user.

Recipients and Retention Period

Your data will be retained by USPORTFOR for a certain period of time, yet never longer than is necessary for the performance of activities, unless in case of a legal provision, incident (e.g. a fight), request, objection or complaint. In such cases, the image information concerned shall be retained for as long as is necessary for processing. The image information is deleted upon completion.

    • TNO

TNO is an independent knowledge institute whose mission is to connect people and knowledge in order to create innovations that sustainably reinforce the competitiveness of companies and society’s wellbeing. TNO supports Usportfor in the development of the software of the camera system.

    • Recordings in Private Mode

Images recorded in Private mode are only available to authorised users of the club. These images are removed from its servers by Usportfor after 10 days. This period may occasionally be extended.

    • Recordings in Public Mode

Images recorded in Public mode are immediately available online and can be downloaded from the Usportfor platform by authorised users of the club. These images are stored for 5 years.

    • Newsletters

Your email address and first name will be stored in Mailchimp. The storage of your data is for an indefinite period of time. You can unsubscribe at any time via the link at the bottom of the newsletters or by sending an email to privacy@USPORTFOR.nl.

    • Contact us

E-mail from USPORTFOR is hosted at Netbulae. If you contact us via the forms or via e-mail, these e-mails are stored on Netbulae’s servers in the Netherlands and/or on our CRM system.

    • Servers

The servers used by Usportfor for email, website and image storage are located in the Netherlands.

    • Third party services

You may be able to login to USPORTFOR using third-party accounts, such as Facebook. If you log in through another party’s account, we may receive information about you, including your third-party profile information or your use of the third-party account.

    • Analytics

The data collected on the website and app is retained for an indefinite period of time.

Security

USPORTFOR uses physical, organisational and technical safeguards designed to protect the integrity and security of your personal data. The automatic cameraman consists of a camera system, a Real-time Image Analyser (RIA) and a dedicated router. Via this router, the images reach the Usportfor servers. If the club has recorded the images in public mode, the images are immediately available online. If the club records the images in private mode, the images can only be downloaded by authorised users at the club.

Your data is only managed in the aforementioned systems and software. The personal data managed by USPORTFOR or by the aforementioned third parties can only be accessed via the above software and is appropriately technically and organisationally secured. Periodically, an evaluation is made as to whether the security measures are still adequate.

Protection of the privacy of young children is particularly important to USPORTFOR. For this reason, Usportfor does not intentionally collect or maintain personally identifiable data from persons under the age of 16. If Usportfor learns that personally identifiable data of persons under the age of 16 has been collected on or through the Usportfor Service, Usportfor will take appropriate steps to delete such data. If you are the parent or legal guardian of a child under the age of 16, who, unwillingly, has become an Usportfor member, please contact Usportfor at privacy@Usportfor.com to terminate that child’s account and delete the data.

Your rights

    • Right of inspection

You have the right at all times to request your data which are recorded and stored. You can do so by sending an e-mail or contacting the sports club concerned by telephone. A request for inspection may be rejected if your request for inspection is unspecified, or if you are manifestly abusing the law by making such a request. In the event of an incident, a request for inspection may be refused if this is necessary in the interests of the prevention, investigation and prosecution of criminal offences.

    • Right of rectification

Is your data not correct? Or has your data changed? You have the right to have this rectified by the club or by Usportfor.

    • Right of transfer

If you need the data stored at Usportfor in case you switch to another party or service, you have the right to transfer. Usportfor will consequently transfer all your data to the other party.

    • Right to erase data

Do you no longer want your data retained at Usportfor? Then you have the right to have your data deleted. A request for inspection may be refused if your request to be forgotten is unspecified, or if you are manifestly abusing the law by making such a request. In the event of an incident, a request to be forgotten may be (temporarily) refused if this is necessary in the interest of the prevention, detection and prosecution of criminal offences.

    • Right to lodge a complaint

You have the right to file a complaint with the Personal Data Authority if you feel that Usportfor is not handling your data correctly. You can do so via this link.

    • Right to stop data use (objection)

Do you not want Usportfor to use your data? Then you have the right to stop the use of your personal data. These rights can be exercised via privacy@Usportfor.com by sending a copy of an ID in which the passport photo, the numbers at the bottom of the passport, ID-certificate number and Citizen Service Number have been made illegible. The aim is to respond within a week.

Obligations

In addition to its journalistic activities, Usportfor also processes personal data on the basis of a legitimate interest: a commercial interest, such as offering services or products of Usportfor.
The data required to be supplied is the data required to offer our services or products. For example, your e-mail address is required to send your information. If these mandatory details are not provided, Usportfor may not be able to offer the service in question.
Should it be necessary to share data that you have shared with Usportfor with parties other than the parties mentioned above (for example to offer a service), your permission will first be requested.

Usportfor reserves the right to disclose the information when required to do so by law or when Usportfor believes such disclosure is appropriate to comply with a legal request/proceedings or to protect Usportfor’s rights, property or safety. We always endeavour to respect your right to privacy as much as possible.
